Abstract


The author dwells upon the problems of legal control of volost judges’ independence in the post-reform Russia and the problems of law-enforcement practice. Under analysis is the problem of separating the volost court from administrative authorities and material security of judges, etc. The author concludes within the period of developing regulatory legal system for implementation of the peasant reform it was impossible to create an effective system of ensuring judges’ independence due to several reasons. One of them was that there was lack of unity among legislators in the issue of giving guarantees of judges being independent. Besides, the government considered volost courts to be exclusively peasant courts.
